By using the Yahoo! Dating for SMS Service, you acknowledge and agree that: (a) your mobile phone number (MSISDN) will be used during the transmission of text messages through the Yahoo! Dating for SMS Service,

(b) the cost of a normal SMS will be charged to your Hutch, RPG, or Airtel phone (as the case may be) for each SMS sent from your mobile phone number, as per the terms of subscription prescribed by your cellphone service provider.

(c) you remain solely responsible for all content originated by and from you and transmitted via the Yahoo! Dating for SMS Service ("Content"), and you shall accordingly indemnify Yahoo, Hutch, RPG, and Airtel, (as the case may be) against all third party claims relating to your Content directly or indirectly or your use of the Yahoo! Dating for SMS Service or due to your act, negligence, omission or commission and

(d) neither Yahoo! nor Hutch, RPG, or Airtel (as the case may be) will be liable for any costs, loss or damage (whether direct or indirect), or for loss of revenue, loss of profits or any consequential loss whatsoever as a result of your using the Yahoo! Dating for SMS Service.

(e) neither Yahoo! nor Hutch, RPG, or Airtel (as the case may be) make any and hereby specifically disclaims any and all representations and warranties, express or implied, with respect to the Yahoo! Dating for SMS Service. Without limiting the generality of the foregoing Yahoo, Hutch, RPG, and Airtel (as the case may be)specifically disclaim any and all implied warranties of fitness for a particular purpose, merchantability, title and non-infringement and Yahoo!, Hutch, RPG, and Airtel (as the case may be) do not represent or warrant that the provision of the Yahoo! Dating for SMS Service shall be error free, uninterrupted or virus free.

(f) neither Yahoo nor Hutch, RPG, or Airtel (as the case may be)shall have any liability whatsoever for any failure or delay in the Yahoo! Dating for SMS Service resulting from any governmental action, fire, flood, insurrection, earthquake, power failure, riot, terrorist act, explosion, strikes whether legal or illegal, labor or material shortage, transportation interruption, work slowdown, or any other condition beyond the control of Yahoo! or Hutch, RPG, or Airtel (as the case may be).
